Attendees will learn the implications of dual agency created when a firm represents more than one client in a transaction. Included will be an examination of the types of behavior changes required of agents in dual transactions. Single-licensed dual agency, dual licensed dual agency, designated agency and the associated modification of the fiduciary duties will be explored in detail. Field situations, pending legislation, issues of confidentiality and changes in advocacy positions will be addressed.
